DISTANCE SALES AGREEMENT

This Agreement (“Agreement”) is entered into between the following parties:

Eda Güngör Giysi Tasarım ve Danışmanlık Ticaret Limited Şirketi, a company subject to Turkish law (hereinafter referred to as “Museum Of Fine Clothing”)

The buyer who purchases the product from www.museumofc.com (hereinafter referred to as “Buyer”)

Museum Of Fine Clothing and Buyer shall be referred to collectively as the “Parties.”


ARTICLE 2 - SUBJECT OF THE AGREEMENT

The subject of this Agreement is to determine the mutual rights and obligations of the Parties regarding the purchase of custom-made or personalized products requested by the Buyer through www.museumofc.com and the delivery of these products by Museum Of Fine Clothing to the Buyer.


ARTICLE 3 - PRODUCTS AND SERVICES ON THE WEBSITE

I. The fundamental characteristics of the products and services offered by Museum Of Fine Clothing are available at www.museumofc.com. The Buyer cannot request performance from Museum Of Fine Clothing based on information not available on the website.

II. The prices listed and advertised on the website are sales prices. Museum Of Fine Clothing reserves the right to update and change prices and promotions at any time.

III. The sales price of the product or service does not include value-added tax (VAT), customs duties, or other taxes. These taxes shall be paid by the Buyer in accordance with the tax system of their country.

IV. Museum Of Fine Clothing shall deliver the fully paid product to the Buyer within a maximum of thirty (30) days, provided it is in stock.


ARTICLE 4 - SHIPPING AND DELIVERY METHOD

I. Museum Of Fine Clothing shall send the purchased products to the Buyer in a special protective box through its contracted courier service within the specified delivery time, unless otherwise requested by the Buyer.

II. Taxes and delivery charges are not included in the product prices and shall be paid directly by the Buyer.

III. Museum Of Fine Clothing shall not be held responsible for delays or non-delivery of products due to issues caused by the courier company.

IV. In case of a damaged package, the Buyer must refuse delivery and request a report from the courier company. If the package is accepted, the courier company is deemed to have fulfilled its duty, and all responsibility is transferred to the Buyer.

V. All information provided by the Buyer must be accurate and complete. Any losses resulting from incorrect or incomplete information shall be fully covered by the Buyer.


ARTICLE 5 - RETURN AND EXCHANGE POLICY

I. All products listed on www.museumofc.com are customized according to the Buyer’s measurements and requests. Therefore, orders cannot be changed or returned.

II. The Buyer does not have the right to withdraw from or terminate the contract. In case of withdrawal, the prepayment will be retained as a cancellation fee.


ARTICLE 6 - BUYER’S DECLARATIONS AND WARRANTIES

I. The Buyer declares that they have read and understood all the preliminary information available on www.museumofc.com regarding the characteristics, price, payment methods, and delivery conditions of the purchased product.

II. All intellectual property rights and materials on www.museumofc.com belong exclusively to Museum Of Fine Clothing. The Buyer agrees not to infringe upon these rights.


ARTICLE 7 - MUSEUM OF FINE CLOTHING’S RIGHTS AND OBLIGATIONS

I. Museum Of Fine Clothing is responsible for providing the product purchased by the Buyer in a complete and defect-free manner.

II. The Buyer must inspect the received product and report any defects within seven (7) days.


ARTICLE 8 - INTELLECTUAL PROPERTY RIGHTS AND DATA PROTECTION

I. The Buyer acknowledges that they have read and accepted the Privacy Policy and Data Protection Notice on www.museumofc.com.


ARTICLE 9 - FORCE MAJEURE

I. Museum Of Fine Clothing shall notify the Buyer in case of any force majeure event that prevents the delivery of the product.


ARTICLE 10 - OTHER PROVISIONS

I. In cases where this agreement does not contain provisions, the Consumer Protection Law No. 6502 and the Turkish Commercial Code shall apply.

II. In case of disputes, Istanbul Central Courts shall have jurisdiction.

III. Museum Of Fine Clothing reserves the right to unilaterally modify this agreement.
